1) Scope of application

1.1 These general terms and conditions of contract (hereinafter “General Terms”) of Florian Pavimenti in Legno (hereinafter the “Seller”) apply to all contracts concluded by a consumer or a trader (hereinafter the “Customer”) with the Seller with regard to the goods and/or services offered for sale in the Seller’s online shop. The application of the Customer’s own terms is excluded, unless otherwise agreed.

1.2 For the purposes of these General Terms, “consumer” means any natural person who enters into a legal transaction for purposes that do not fall within the scope of their independent commercial or professional activity. “Trader” means any natural or legal person, or partnership with legal personality, who, when entering into a legal transaction, acts for purposes attributable to their independent commercial or professional activity.

2) Conclusion of the contract

2.1 The product descriptions in the Seller’s online shop constitute binding offers on the part of the Seller.

2.2 The Customer may accept the offer using the order form provided in the Seller’s online shop. When ordering via the online order form, after entering their personal data the Customer, by clicking the confirmation button at the end of the checkout process, gives legally binding acceptance of the contractual offer with regard to the goods in their cart. However, the offer may only be accepted if the Customer, by ticking the box below the text “I expressly declare that I have read and accept the General Terms and Conditions of Sale”, confirms acceptance of the contractual terms.

2.3 The Seller will send the Customer an order confirmation by e-mail.

2.4 If an offer is accepted via the Seller’s online order form, the text of the contract will be stored by the Seller and sent to the Customer after the order has been placed, together with the text of these General Terms (e.g. by e-mail). The text of the contract will also be archived on the Seller’s website and the Customer will be able to access it free of charge through their password-protected account by entering the relevant login details, provided that the Customer created an account in the Seller’s online shop before placing the order. In any case, the Seller will send the Customer an order confirmation, indicating the possibility of downloading and printing the General Terms using the “print” function.

2.5 Before the binding submission of the order via the Seller’s online order form, the Customer may correct their data at any time using the usual mouse and keyboard functions. In addition, before the binding transmission of the order, all data will be displayed in a confirmation window where it can still be amended using the usual mouse and keyboard functions.

2.6 If the Customer acts as a consumer, the only language available for the conclusion of the contract is Italian.

3) Right of withdrawal

3.1 Consumers are entitled to exercise the right of withdrawal.

3.2 For further information on the right of withdrawal, please refer to the Seller’s withdrawal policy.

4) Prices and payment terms

4.1 The prices indicated by the Seller are final amounts inclusive of the VAT rate provided for by law. Any additional delivery and shipping costs are indicated on the relevant product description page.

4.2 Shipments to countries outside the European Union may involve additional specific costs to be borne by the Customer. These include, for example, costs related to money transfers through credit institutions (e.g. bank transfer fees, currency exchange) or import taxes and charges (e.g. customs duties).

4.3 The Customer has several payment options available, as illustrated on the Seller’s website.

4.4 If the Customer opts for payment via “PayPal”, the payment will be processed by the service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under the PayPal terms of use available at https://www.paypal.com/it/webapps/mpp/ua/legalhub-full?locale.x=it_IT. This requires, among other things, that the Customer opens a PayPal account or already has one.

5) Delivery and shipping conditions

5.1 The goods are shipped by carrier to the address indicated by the Customer. The order is processed taking into account the shipping address provided.

5.2 If the carrier returns the goods to the Seller due to impossibility of delivery to the Customer, the costs of the unsuccessful shipment shall be borne by the Customer. This does not apply if the Customer exercises the right of withdrawal, where the circumstance that made delivery impossible is not attributable to the Customer, or where the Customer was temporarily unable to accept the service offered, unless the Seller had given reasonable advance notice of the performance of such service.

5.3 In the case of collection by the Customer, the Seller will inform the Customer by e-mail that the ordered goods are ready for collection. Upon receipt of the e-mail, the Customer may collect the goods from the Seller’s premises. In this case no shipping costs will be charged.

6) Statutory warranty of conformity

6.1 The statutory provisions on warranty for defects in the goods sold shall apply.

6.2 The consumer must notify the Seller of any defect in the goods upon delivery.

7) Applicable law, jurisdiction

7.1 If the Customer acts as a consumer within the meaning of point 1.2, all legal relationships between the parties shall be governed by the law of the country in which the Customer has their habitual residence, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from this contract shall be the Customer’s place of domicile.

7.2 If the Customer acts as a trader within the meaning of point 1.2, all legal relationships between the parties shall be governed by the law of the country in which the Seller has its registered office, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from this contract shall be the place of the Seller’s registered office.
